AUCTION TERMS & POLICIES

 Welcome to Oliver’s Auction. Below you’ll find our complete policies regarding bidding, payments, shipping, pickup, item condition, and other important auction information.

By registering to bid or placing a bid in an Oliver’s Auction sale, you agree to the applicable Terms & Conditions below.

Bidding & Item Condition

 

ALL BIDS ARE BINDING.

By registering to bid and/or placing a bid, you acknowledge that you have read, understand, and agree to Oliver’s Auction’s Terms & Conditions and all auction-specific information published for the sale.

Bids may not be retracted or cancelled because a bidder changed their mind, bid in error, failed to inspect an item, failed to read the description or terms, or later determined that pickup or shipping would be inconvenient or costly. Any correction or cancellation is at the discretion of Oliver’s Auction, LLC and subject to applicable bidding-platform rules.


AS-IS, WHERE-IS.

All property is sold AS-IS, WHERE-IS, WITH ALL FAULTS AND WITHOUT RECOURSE, except as otherwise required by applicable law.

Catalog descriptions, photographs, condition reports, estimates, attributions, dates, dimensions, provenance, and other information are statements of opinion offered in good faith as a guide and are not guarantees.

Dimensions are approximate. Photographs may not show every defect, repair, alteration, restoration, or condition issue. Lamps, clocks, mechanical items, electrical items, and similar property are considered untested unless expressly stated otherwise and may require inspection, repair, or rewiring before use.

Preview periods are provided when available so bidders may inspect property before bidding. It is the bidder’s responsibility to determine condition, authenticity, age, value, suitability, completeness, and other relevant characteristics before bidding.

Failure to attend preview, inspect an item, request additional information, or otherwise investigate property does not create a right to cancel a purchase.


ALL SALES ARE FINAL. 

No returns, exchanges, or refunds are permitted except where required by law or expressly provided in these Terms.

Online auctions may use staggered closing and extended or soft-close bidding. Lots close according to the functionality and published procedures of the applicable bidding platform.

BUYER’S PREMIUM & TAXES

 

BUYER’S PREMIUM

A mandatory 20% Buyer’s Premium is added to the hammer price of every lot unless a different premium is expressly published for a particular auction.

The Buyer’s Premium is part of the total purchase price and applies regardless of the buyer’s selected fulfillment or payment method.

Additional bidding-platform or payment-processing fees may apply and will be disclosed through the applicable bidding platform.


SALES TAX

Applicable sales tax will be collected as required by law and according to the procedures of the applicable bidding platform or payment processor.

Tax-exempt buyers are responsible for providing valid resale or exemption documentation in accordance with applicable requirements before payment.

Submission of exemption documentation after an invoice has been paid does not guarantee that previously collected sales tax can be removed or refunded.

PAYMENT POLICY

 

Successful bidders are legally obligated to pay the hammer price, Buyer’s Premium, applicable sales tax, platform or payment-processing fees, and any other authorized charges associated with the transaction.

Available payment methods and processing procedures may vary depending upon the bidding platform used. An authorized payment method on file may be processed automatically in accordance with the policies and settings of the applicable bidding platform.

A declined or failed payment does not cancel the transaction or relieve the buyer of the obligation to pay.

Oliver’s Auction reserves the right to require wire transfer, certified funds, government-issued identification, address confirmation, payment verification, or another secure payment method for high-value purchases, transactions presenting elevated fraud risk, or other circumstances in which additional verification is reasonably necessary.

Property may be withheld from pickup, shipment, or delivery until payment has cleared and any requested verification has been completed.

Unresolved unpaid invoices may result in cancellation of the sale, loss of rights to the property, resale or other lawful disposition of the property, collection action, reporting of nonpayment to the applicable bidding platform, and suspension or permanent loss of bidding privileges.


CASH PAYMENTS

When cash payment is permitted through the applicable bidding platform, buyers intending to pay cash at pickup must notify Oliver’s Auction by text message at (864) 559-3891 no later than midnight on the date the auction closes.

The message must include the buyer’s full name, bidder number, and a statement that they intend to pay cash at pickup. Other forms of communication do not satisfy this requirement unless expressly acknowledged and approved by Oliver’s Auction.

SHIPPING & DELIVERY

 

HOW SHIPPING WORKS

Shipping is available for eligible property; however, online bidding does not mean that every item can be shipped.

Depending on the item and bidding platform, fulfillment options may include Oliver’s Auction in-house shipping, platform-provided shipping, free local pickup, regional delivery, buyer-arranged transportation, courier service, UShip, freight, or specialty movers.

Large, heavy, furniture-sized, unusually fragile, regulated, or difficult-to-transport property may not qualify for ordinary parcel shipping.


OLIVER’S AUCTION IN-HOUSE SHIPPING

Oliver’s Auction offers in-house packing and shipping for eligible purchases through our ShippingSaint fulfillment process.

Following the auction, eligible buyers may receive a text message and/or email through ShippingSaint requesting that they select PICKUP or SHIPPING.

Your auction purchase invoice must be paid in full before your property can be processed for in-house shipping.

Your shipping invoice is separate from your auction purchase invoice and is generally issued through ShippingSaint.


WHAT DOES THE SHIPPING CHARGE INCLUDE?

In-house shipping charges may include carrier/postage charges, boxes and shipping containers, packing and protective materials, labor and handling, insurance, signature services, specialty services, and other costs reasonably necessary to safely prepare and transport your property.

The shipping charge is therefore not limited to the postage amount appearing on the carrier’s shipping label.

Oliver’s Auction may select UPS, USPS, FedEx, Pirate Ship-supported carrier services, or another commercially reasonable carrier based on the item, destination, dimensions, weight, cost, and shipping requirements.

In-house shipping charges are non-negotiable after calculation except to correct an actual billing or calculation error.


HOW LONG DOES SHIPPING TAKE?

Eligible in-house shipments are generally processed within approximately 5–10 BUSINESS DAYS after the auction invoice has been paid in full and payment has been verified.

This is processing time and does not include carrier transit time.

Processing times are estimates and may vary due to auction volume, packing requirements, shipment size, holidays, weather, carrier availability, unusually fragile property, or other circumstances.


WHEN IS MY SHIPPING INVOICE DUE?

Oliver’s Auction in-house shipping invoices must be paid within 10 CALENDAR DAYS of issuance.

If a circumstance prevents timely payment, the buyer must contact Oliver’s Auction before the deadline. At its discretion, Oliver’s Auction may approve one extension of up to five additional calendar days.

Failure to pay shipping charges within the applicable deadline may result in the property being treated as abandoned or forfeited to the fullest extent permitted by applicable law.


PLATFORM-PROVIDED SHIPPING

Some bidding platforms may offer their own shipping or fulfillment programs. When a buyer selects platform-provided shipping, the rates, carriers, payment procedures, insurance, claims procedures, and other terms may be established by the applicable platform or its independent shipping provider.

Oliver’s Auction cannot guarantee that a platform-provided shipping selection can be changed after checkout and cannot modify, reduce, waive, or refund shipping charges established or collected directly by an independent bidding platform or shipping provider.

Buyers should carefully review their selected shipping method and associated charges before completing checkout.


LARGE ITEMS & REGIONAL DELIVERY

Oliver’s Auction may offer regional delivery for qualifying purchases and destinations.

Regional delivery charges begin at $99 but are not flat-rate. Actual cost depends upon destination, distance, route, quantity, size, property type, handling requirements, and other circumstances.

Furniture, oversized property, unusually fragile items, and other property unsuitable for ordinary parcel shipping may require regional delivery, independent courier, UShip, freight, specialty movers, local pickup, or buyer-arranged transportation.

SHIPPING DAMAGE & CLAIMS

 

If an item shipped through Oliver’s Auction’s in-house shipping process arrives damaged, the buyer must notify Oliver’s Auction within FIVE (5) BUSINESS DAYS OF DELIVERY.

DO NOT DISCARD THE BOX OR PACKING MATERIALS.

Please retain:

• The damaged item • The exterior shipping box or container • All interior packing materials • Shipping labels • Any damaged packaging

Take clear photographs of the damaged item, exterior box, interior packing materials, and any visible damage to the package.

Photographs and additional documentation may be required to process an insurance claim.

Failure to retain the original packaging, provide requested documentation, or report damage within the required time may affect or prevent recovery under applicable shipping insurance.

If shipping was purchased directly through a third-party bidding platform or shipping provider, the buyer may also be subject to that provider’s claims procedures and deadlines.

LOCAL PICKUP

 

HOW PICKUP WORKS

Free local pickup is available during the pickup dates and times published for each auction.

Following the auction, buyers may receive a text message and/or email through ShippingSaint requesting that they select PICKUP or SHIPPING.

If you choose pickup, you must select an available pickup appointment through ShippingSaint when requested.

Simply selecting “Pickup” without scheduling an appointment does not reserve a pickup time.

Unless alternative arrangements have been expressly approved by Oliver’s Auction, purchases must be removed during the published pickup period.


SOMEONE ELSE PICKING UP FOR YOU?

Another person may pick up your purchases. Please contact Oliver’s Auction before that person arrives and provide their name.

Identification or additional verification may be required before property is released.


LOADING YOUR PURCHASES

Buyers are responsible for bringing sufficient personnel, vehicles, tools, boxes, blankets, packing materials, dollies, and other equipment necessary to safely remove their purchases.

Oliver’s Auction staff may assist with loading as a courtesy when reasonably possible; however, loading assistance is not guaranteed.

Once property has been released from Oliver’s Auction’s possession, the buyer assumes responsibility for handling, loading, securing, transportation, loss, theft, and damage.


CAN’T MAKE YOUR PICKUP?

Contact Oliver’s Auction before the scheduled pickup period ends if you need to request alternative arrangements. Alternative arrangements are not guaranteed and must be expressly approved.

MISSED PICKUP, STORAGE & UNCLAIMED ITEMS

 

MISSED PICKUPS

If a buyer selects pickup but fails to retrieve eligible paid property during the scheduled pickup period without making alternative arrangements, eligible property may be transferred to Oliver’s Auction’s shipping department.

The buyer will then be responsible for applicable packing materials, labor, handling, insurance, and shipping charges.

If an item has already entered the packing or shipping process and the buyer later requests pickup, charges already incurred for packing, unpacking, materials, or labor may remain due.


FURNITURE & LARGE-ITEM STORAGE

Unless prior arrangements have been expressly approved, large, furniture-sized, oversized, or other property that cannot reasonably be transferred to our normal shipping department and remains after 5:00 PM on the Friday of the applicable pickup week is subject to a storage charge of:

$25 PER ITEM, PER CALENDAR DAY

All applicable storage charges must be paid before property will be released.


UNCLAIMED PROPERTY

Unless prior arrangements have been expressly approved, purchased property remaining unclaimed and not removed within 10 BUSINESS DAYS following the scheduled pickup period may be considered abandoned and forfeited to the fullest extent permitted by applicable law.

Upon lawful forfeiture, Oliver’s Auction may resell, consign, donate, dispose of, or otherwise handle the property.

Except where required by law, amounts previously paid will not be refunded when forfeiture results from the buyer’s failure to retrieve the property.

Buyers experiencing an unexpected issue should contact Oliver’s Auction before the applicable deadline to discuss possible arrangements.

DISPUTES, CHARGEBACKS & LIABILITY

 

PAYMENT DISPUTES & CHARGEBACKS

Buyers should contact Oliver’s Auction promptly regarding legitimate billing errors or concerns so that we have an opportunity to investigate and resolve the matter.

A buyer shall not knowingly initiate a false, fraudulent, or improper chargeback or payment reversal concerning a valid charge.

Buyer’s remorse, accidental bidding, failure to inspect property, disagreement with disclosed condition, failure to retrieve property, failure to monitor communications, or disagreement with properly disclosed Buyer’s Premium, shipping, handling, storage, or payment-processing charges does not by itself constitute a contractual basis for reversing an otherwise valid charge.


THIRD-PARTY SERVICES

Oliver’s Auction utilizes independent third-party services that may include online bidding platforms, ShippingSaint, payment processors, shipping providers, carriers, couriers, freight providers, and other service providers.

Except where otherwise required by law, Oliver’s Auction is not responsible for acts, omissions, outages, delays, failures, or pricing determinations solely attributable to an independent third party outside Oliver’s Auction’s reasonable control.


LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Oliver’s Auction shall not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from an auction transaction.

Except where otherwise required by law, Oliver’s Auction’s maximum liability concerning an individual lot shall not exceed the hammer price and applicable Buyer’s Premium actually paid for that lot.

AUCTIONEER AUTHORITY & LEGAL TERMS

 

AUCTIONEER AUTHORITY

Oliver’s Auction reserves the right to take commercially reasonable actions necessary to preserve the integrity of an auction, including correcting material clerical or catalog errors, resolving bidding disputes, rejecting invalid bids, reopening or reoffering a lot when permitted, withdrawing property before sale, or responding to material technical failures.

Auctions are conducted without reserves unless expressly stated otherwise for a particular auction or lot.

Oliver’s Auction does not place bids on behalf of consignors for the purpose of artificially increasing the selling price or protecting an undisclosed minimum price.


COMMUNICATIONS

Buyers may receive transactional communications by email and/or text from Oliver’s Auction and service providers involved in completing the transaction, including the applicable bidding platform, ShippingSaint, payment processors, and shipping providers.

Buyers are responsible for monitoring the email address and telephone number associated with their bidding account, including spam and junk folders.

Failure to receive, notice, open, or respond to an invoice, email, text message, pickup request, ShippingSaint notification, platform communication, or reminder does not extend applicable payment, pickup, shipping, storage, or other deadlines.


GOVERNING LAW & VENUE

These Terms & Conditions are governed by the laws of the State of South Carolina.

To the fullest extent permitted by applicable law, legal proceedings arising from an Oliver’s Auction transaction shall be brought in a court of competent jurisdiction located in Anderson County, South Carolina.

Before filing suit, the parties agree to make a reasonable good-faith effort to resolve a dispute directly for 30 calendar days following written notice, except where immediate action is reasonably necessary to preserve legal rights, collect an unpaid obligation, address fraud, respond to a chargeback, recover property, or obtain emergency relief.

ACCEPTANCE OF TERMS

BY REGISTERING TO BID AND/OR PLACING A BID, YOU ACKNOWLEDGE THAT YOU HAVE BEEN PROVIDED ACCESS TO THESE TERMS, HAVE HAD AN OPPORTUNITY TO REVIEW THEM, UNDERSTAND THAT ALL BIDS ARE BINDING, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS AND ALL AUCTION-SPECIFIC INSTRUCTIONS.



If you do not agree to these Terms & Conditions, do not register for or place a bid in an Oliver’s Auction sale.
